General Information:

eBay, Inc. is a Delaware corporation with it’s corporate office at 2145 Hamilton Ave, San Jose, CA 95125. eBay has been granted a corporate charter by The State of California as a foreign for-profit corporation. eBay was initially incorporated as eBay, Inc. in California on May 13, 1996. But on March 13, 1998, a corporation called eBay, Inc. was created in Delaware. On April 28, 1998, the California eBay corporation was merged into the Delaware corporation eBay, Inc. by operation of a merger agreement. It is this Delaware eBay, Inc. that remains today and operates the eBay we have all come to know and not necessarily love.

Most users on eBay have a relationship with eBay, Inc. However, eBay also has formed two other entities, eBay Foundation (incorporated in California) and eBay Real Estate, Inc. (another Delaware corporation) and it is possible that your legal relationship exists with these entities. It could also exist with two or more of these entities at the same time.

None of this is unusual, but it is useful knowledge to have. Many companies chose to incorporate in Delaware (and Nevada) due its extremely business-friendly laws, low taxes and other assorted perks. This is important if you decide to sue eBay, since you have to be sure you are suing the right eBay and have a basic understanding of its business structure.

Requests for Removal:

I will not honor any requests for removal regardless of reason or person making the request from this list unless one of the following is true:

1. You have obtained a valid court order that specifically directs me to remove the number and properly served it upon me (I do not accept service of legal documents by facsimile). Be aware that any such orders will be immediately contested and you may be sued for violating my rights.
2. I receive a request from a law enforcement agency on their letterhead asking that the number be removed because its continued presence on this list may put another at risk for injury or harm. In these cases, I will accept service of the request by facsimile and will remove the number only (the name will remain, with a notation that the number was removed at the request of law enforcement) for ninety days to allow time to obtain and serve a court order. If a court order is not forthcoming, the number will be reposted and will not be removed until a court order is obtained and properly served (I do not accept service of legal documents by facsimile).
3. I receive a notarized declaration that states under the penalties and pains of perjury that the listed number is not under the care, custody or control of eBay, one of its employees or contractors or anyone acting on their behalf in any way. The declaration must include a provision for irrevocable consent to the jurisdiction of the state and federal courts of the State of Oklahoma, County of Cleveland, a promise to immediately pay ten thousand dollars (one hundred thousand dollars in the case of a company with a gross income exceeding $5 million dollars in the past calender year and one million dollars for companies with gross income that exceeded $25 million in the past calender year) to the 501(c)(3) non-profit charity of my choice should it be proven that declaration contained a false statement and a statement agreeing to reimburse me in full for reasonable, documented costs of any and all expenses of any and every kind associated with prosecution of false statements by civil lawsuit or other legal proceeding, including, but in no way limited to, court costs, printing, document production, filing fees, copy charges, retrieval charges, research charges, postage, travel to and from hearings, lodging while attending court hearings.

It is my position that the telephone numbers used for business purposes belonging or assigned to representatives, employees, agents, contractors and assigns of a company that does business with the public for a fee are not private nor personal information and that employees have no reasonable expectation of privacy under the law as it pertains to such telephone numbers. As such, and in the interests of making such information public and freely available, I reserve the right to refuse to remove any number from this list at any time and for any reason, or for no reason at all.
